Friends, today was a critical milestone in our fight to defend birthright citizenship in the Supreme Court, and I want to share an update with you on where we stand:
This morning, the Supreme Court heard oral arguments in Trump v. Barbara, a case that was brought by a class of children who would lose their citizenship under Donald Trump's executive order ending birthright citizenship.
I want to be clear about what's at stake: if Trump's unlawful executive order is allowed to stand, hundreds of thousands of children born each year would be stripped of their ability to fully and fairly participate in our society as American citizens.
They would lose their most basic rights guaranteed by the Constitution.
Birthright citizenship is foundational to American democracy. It's the promise that any child born here is equal under American law, regardless of race, class, creed, or parental background — and it's a guarantee that every child born here has a personal stake in the American dream.
It tells you something that on the very first day of his second term, Trump attempted to strike down this fundamental and longstanding right with an executive order — a right guaranteed by the 14th Amendment, and the rule that has governed our nation for more than 150 years.
I sued him within hours. Lower courts repeatedly issued nationwide injunctions blocking his order from taking effect, and every court to consider this question has rejected Trump's unlawful overreach.
But Trump hasn't given up — and neither have we.
In February, I co-led a coalition of 24 attorneys general in filing an amicus brief defending the children who would lose their citizenship under Trump's order. And today, we brought that fight to the highest court in the land.
After listening to oral arguments this morning, I'm optimistic. The text of the Constitution and more than a century of legal precedent are clear — and I believe Trump's attempt to undermine the rights of millions will fail.
